Welcome to TheBarcodeStore! Thank you for visiting our website. This page forms the Terms and Conditions in accordance with which we supply Products (each a “Product”) and Services (each a “Service”) listed on our website www.thebarcodestore.com (the “Site”) to you (the “Terms and Conditions”). In these terms and conditions, “we”, “us” and “our” refer to TheBarcodeStore and “you” and “your” refer to the person, firm or corporation purchasing the Goods indicated in your Order (an “Order”).

Please take some time to read these Terms and Conditions before using the Site. Your use of the Site indicates that you have acknowledged, understood and agree to be bound by these Terms and Conditions. You should visit our page regularly to note any changes we have made to our Terms and Conditions.

1. Access and Use of Site
As a condition of your access to and/or use of the Site, you warrant that: all information supplied by you on the Site is accurate, current and complete; you are 18 years of age or older in order to access and/or use the Site; and you will not copy or distribute any part of the Site in any medium without TheBarcodeStore’s prior written authorisation.
You shall be solely responsible for your access to and/or use of the Site and its materials herein.
When you create a user account and password, you must treat such information as confidential and you must not disclose it to any third party. We reserve the right to disable any user account at any time, if in our opinion you have failed to comply with any of the provisions of our Terms and Conditions.

2. Prohibited Activities
You agree and undertake not to: use the Site for illegal purposes, commit or encourage a criminal offence; transmit or distribute a virus, including but not limited to Trojan, worm, logic bomb or post any other material which is malicious, technologically harmful, in breach of confidence or in any way offensive, defamatory, libellous or threatening; hack into any aspect of the Service; corrupt data; cause annoyance to other users; or attempt to affect the performance or functionality of any computer facilities of or accessed through this Site; impersonate any person or entity or to falsely state or otherwise misrepresent your affiliation with any person or entity; infringe upon the rights of any other person’s proprietary rights; post, promote or transmit through the Site any information, graphics, photographs, data, unsolicited advertising or promotional materials and/or any other material that contains any computer virus or other invasive or damaging code, program or macro; is obscene, pornographic, indecent, counterfeited, fraudulent, stolen, harmful or otherwise illegal under any applicable law; and/or is or may be construed as offensive and/or otherwise objectionable, in our sole opinion. Breaching this provision would constitute to an offence of any connected computer networks, any applicable Internet standards and any other applicable laws. In the event such a breach occurs, it will be reported to the relevant law enforcement authorities and appropriate legal action will be taken.

3. Intellectual Property, Software and Content
The intellectual property rights in all software and content made available to you on or through this Site remains the property of TheBarcodeStore.

4. Warranties and Liability
Access to and use of this Site, its Services and all information provided herein is permitted on a temporary and “as available” basis without warranties of any kind, either expressed or implied, and we reserve the right to withdraw or amend the Services without notice. We will not be liable if for any reason this Site is unavailable at any time or for any period. From time to time, we may restrict access to some parts or this entire Site.
Without limiting the generality of the foregoing, we express disclaim of any warranty, condition, guarantee, term or representation (a) as to the reliability, accuracy, completeness and validity of any content or material on the Site; (b) that functions contained on the Site will be secure, uninterrupted or error-free; and (c) that any defects will be corrected. We assume no responsibility and you expressly agree that your use and/or access of the Site is at your sole risk.

Without prejudice to the generality of the foregoing, we expressly disclaim any and all liability arising from: life or wear of any Product or that it will be suitable for any particular purpose or use under any specific conditions, notwithstanding that such purpose or conditions may be known or made known to TheBarcodeStore; improper remedy of defective products, unsuitable or improper use, wilful damage, negligence, or other misuse of the products, as well as fair wear and tear, by you or any third party; third party claims, whether directly or indirectly caused by, or relating to, the content of our Site and the products purchased on or through our Site; and any warranties provided under these T&Cs if the total price for the Product has not been paid in cleared funds by the due date for payment.
You further acknowledge and agree that your access and use of the Site is dependent on third party service providers such as internet, network, connectivity or other link providers. Your payment for any Product purchased from the Site is processed by third party payment system providers and TheBarcodeStore does not retain or process any such payment information. TheBarcodeStore cannot guarantee the security of such third party payment system(s) or any payment data on the Site; is not responsible for any acts or omissions of any third parties and disclaims any; and all liability in connection with the act, omissions or defaults of such third parties. Without prejudice to the generality of the foregoing, TheBarcodeStore is not responsible for the results of any credit inquiry, the availability or performance of the Internet, your connection to the Internet or the actions or inaction of any other person or entity, including any internet service provider. By using the Site, you expressly relieve TheBarcodeStore from any and all liability in connection with the acts, omissions or defaults of such third parties.

5. Indemnities
You agree to indemnify us and hold us and our partners, affiliates, agents and their employees, officers, directors, and representatives harmless from any claims, losses, and damages, including reasonable attorney’s fees, arising out of your access of, use of and/or participation in this Site, including (i) any claims of infringement of a third party’s rights; (ii) damage to tangible property, bodily injury, or death; (iii) negligence or wilful misconduct caused or attributable to you or any of your agents, and (iv) breaches of your obligations under these T&Cs.

6. Terms of Sale

6.1 Order
You may place an order with us by completing and submitting the order form on the Site. You shall be responsible for ensuring the accuracy of all orders. All orders will be deemed to be irrevocable and unconditional upon transmission through the Site, and we shall be entitled, but not obliged, to process such order(s) without your further consent and any further reference or notice to you.
We reserve the right to accept or decline any and all orders received through the Site in our sole and absolute discretion. Our acceptance of your order will take place when a confirmation email is sent to your registered email address with us, at which point a contract will come into existence between you and us. Each fully-paid order accepted by us shall constitute a separate and individual contract governed by the Terms and Conditions (an “Order”). We will assign an order number to your Order when we accept your Order. Please quote to us the order number whenever you contact us about your Order.
If we are unable to process your order, we will inform you of this. This might be because of, but not limited to, the product is out of stock; unexpected limits on our resources for which we could not reasonably plan; because a credit reference we have obtained for you does not meet our minimum requirements; because we have identified an error in the price or description of the product; or because we are unable to meet a delivery deadline you have specified.
We reserve the right to withdraw any Products from this Site at any time and/or remove or edit any materials or content on this Site. We will not be liable to you or any other third party by reason of our withdrawing any Product from this Site, whether it has been sold or not, removing or editing any materials or contents on this Site or for refusing to process or accept an Order.

6.2 Payment
The price payable by you for the Product shall be the price of the Product listed for sale as stated on the Site at the time your order is transmitted to us through the Site, and any applicable taxes. We reserve the right to amend the price of any Product at any time without giving any reason or prior notice. Please complete payment at the moment your order was placed as all unpaid orders will be cancelled automatically.
Whilst we make best efforts to ensure that all details, descriptions and prices which appear on this Site are accurate, there may be instances where errors may occur. In the event that we discover an error in the price of any Product which you have ordered, we will inform you of this as soon as possible and give you the option of reconfirming your Order at the correct price or cancelling it. If we are unable to contact you, we will treat the Order as cancelled. We reserve the right to terminate the Order and notify you of such termination, regardless whether or not the products have been dispatched or are in transit and whether payment has been charged to you.
(a) Unless otherwise stated, all prices are inclusive of GST and are in Singapore Dollars. Delivery costs will be charged in addition where applicable; such additional charges are clearly displayed and included in the ‘Final Total’.
(b) You can pay using any of our payment partners listed on our homepage. Cards are subject to validation checks and authorisation by card issuer. If we do not receive the required authorisation, we will not be liable for any delay or non-delivery.
(c) Upon authorisation of the payment, by clicking the ‘Order Now’ button, you are confirming that the card belongs to you or that you are the legitimate holder of the promotional voucher, and have sufficient funds or credit facilities to cover the cost of the Product.

6.3 Delivery Lead Time
The lead time for delivery will be indicated in your Order Checkout. For pre-order items, the lead time will be confirmed within 3 working days after receipt of Order.
If delivery of your Order is delayed, we will inform you accordingly and the Product will be dispatched after it becomes available. The time for delivery shall not be of the essence, and neither we nor our agents shall be liable for any delay in delivery howsoever caused. We shall not be liable to you for any losses, liabilities, costs, damages, charges or expenses arising out of late delivery.

6.4 Ownership of Product
All risks and responsibility for the Product will be passed to you at the time it is delivered to the address provided to us.

6.5 Product Description
We try to be accurate as reasonably as possible in our descriptions of products available for purchase through the Site. The images of the Products on our Site are for illustrative purposes only. Colours may appear slightly different in reality due to lighting conditions, or variances in computer screen calibration.
We do not warrant that product descriptions or other content on the Site are accurate, complete, reliable, current or error-free. Minor variations in measurements are not considered a defect. You are responsible for ensuring that your sizing measurements are accurate.
If you believe to have received a wrong or defective product, refer to the Section 9.1 below on ‘Incorrect or Defective Product’.

6.6 Termination
We may terminate the Order at any time by writing to you if you do not:
(a) Within a reasonable time of us asking for it, provide us with correct information to enable us to deliver the Product to you; or
(b) Self-collect within the time frame stipulated.
If we terminate the Order in any of the situations set out above, we will make a refund of the money you have paid to us for your Order less 15% for administrative charges. Please note that refunds will be provided only in the form of store credits.

7. Delivery & Collection Conditions
TheBarcodeStore offers local shipping and self-collection services upon the purchase of our Products. We will be offering international shipping soon.

7.1 Delivery
We offer local delivery in Singapore and you may refer to our ‘Order and Delivery’ page for more details. The cost of delivery will be displayed on your Order.
Your Order will be delivered to the address as stipulated in your Order confirmation.
In the event of a failed delivery, you will be responsible for self-collection. Any failed delivery that is unclaimed after fourteen (14) calendar days from the date of attempted delivery will be deemed as a termination of Order and a store credit refund will be made to you accordingly.

7.2 Self-Collection
If you opt for the Products to be collected from TheBarcodeStore directly, please bring along these items at the time of collection:
(a) Your NRIC
(b) The confirmation email from TheBarcodeStore
(c) An authorisation letter, with the Name and NRIC No, of the person you are authorising to collect the Order on your behalf
We reserve the right to refuse collection if improper documentation is provided.
Collection can be made after you have received confirmation of the relevant Order or the stipulated date in your purchase confirmation email. The collection hours are:
Working Days : Monday to Friday (Excluding Public Holidays)
Self-Collection Time : 9.30 a.m. – 11.30 a.m. and 2.30 p.m. – 5.30 p.m.

Goods must be collected within 14 days from the date on which the Goods are ready for collection.
If you do not collect your purchases within fourteen (14) calendar days from the confirmation date, your Order will be deemed as terminated and a store credit refund will be made to you accordingly.

8. Warranty
Warranty Coverage: Only Products sold on TheBarcodeStore that stipulate a warranty period will come with a warranty which covers against manufacturing defects.
Exclusions from warranty coverage: Parts of wear and tear in nature such as belts, rollers, gears, bearings, gaskets, etc, non-operating and cosmetic items, paint, colour or Product finish, accessories used in or with the Product, external cables and cords, or add-on options incorporated to the Product; glass and lens unless specifically covered in the Contract; Software (including operating system and any stored data), defects resulting directly from software installation and/or removal, computer virus, virus prevention and other peripherals; hardware that has been added after the purchase of the original Product; consumables such as toner, print or ink cartridges, bulbs, compact discs, digital tapes, etc.; all batteries (including regular non-chargeable batteries and rechargeable batteries) unless otherwise specifically covered in the Contract; external faults such as wiring, electrical connection or plumbing, piping, trunking, fitting, realigning of signal receivers (poor reception), and consequential loss of any kind; accidental or intentional physical damage and damage by water unless specifically covered in Contract; failure caused by a voltage converter and/or applying incorrect voltage to the Product.

9. Returns and Exchange Policy
All Products sold are non-exchangeable and non-refundable, unless otherwise stated. TheBarcodeStore strictly do not accept change-of-mind returns or exchanges, and there are no exceptions to this.

9.1 Incorrect or Defective Product
For any claim made under this section, the Products must be unused and in their original condition when it is delivered. We reserve the right to reject the exchange or any request for store credit refund if any of these requirements is not fulfilled.
a) Local Sales
If you receive an incorrect or defective Product, kindly contact our service team and notify us within seven (7) calendar days from the delivery date at support@thebarcodestore.com. Please state your order number and a photograph of the incorrect Product or defective Product showing the defect. All other methods of communication will not be officially logged by our system.
For defective Products, we will contact you by email to rectify the problem. We may request you to send your Product back to us and it should reach us within 15 calendar days from our request date. We will test the Product for the defect and if the Product is found to be working normally, the cost of shipping back the Product will be borne by you.
For incorrect Products, if it is not in-stock, you can either wait for the new stock to arrive or opt for a store credit refund to be issued instead.
b) International Sales
If you receive an incorrect or defective Product, kindly contact our service team and notify us within seven (7) calendar days from the delivery date at support@thebarcodestore.com. Please state your order number and a photograph of the incorrect Product or defective Product showing the defect. All other methods of communication will not be officially logged by our system.
For defective Products, we will contact you by email to rectify the problem. Should the problem still persist, you may send the Product back to us for further attention and it should reach us within 15 calendar days from our request date. The cost of return shipping of the Product will be borne by you.
For incorrect Products, if it is not in-stock, you can either wait for the new stock to arrive or opt for a store credit refund to be issued instead.

9.2 Damaged Product
For any Order that uses a Third-Party vendor to deliver the Product to you, we will not be held responsible for any damage to the Product during shipment to you. It is advised that you take up an insurance for the shipment of the Product at your expense.

9.3 Store Credit
Store credit in TheBarcodeStore account can be utilised towards the purchase of any item from our Site. The store credit is strictly non-refundable, non-extensible, non-transferrable and expires one year from the date of issue.

10. Personal Data Protection
We may collect, use and disclose personal data that you provide to us to supply the Product to you, process your payment for the Product, to send you newsletters if you have registered for our mailing list, and other specified purposes. Please see our ‘Privacy Policy’ page for more information.

11. General
Entire Agreement: These T&Cs, which expressly incorporate the Privacy Policy of TheBarcodeStore and the terms and conditions referred to therein, constitute the entire agreement between you and TheBarcodeStore relating to the subject matter hereof, and supersedes any and all prior understandings or agreements (whether oral or written) regarding the subject matter, and may not be amended or modified except in writing or by making such amendments or modifications available on the Site.

Governing Law: These T&Cs and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of Singapore. Any claim or dispute arising out of or relating to these T&Cs and/or your access to and/or use of the Site which cannot be resolved through negotiation will be subject to the non-exclusive jurisdiction of the courts of Singapore.
